**Case Update – 25/03/2026**
Scottish Ministers have decided that they will determine this case, and a direction to that effect is available on the DPEA website. The appointed reporter will now prepare a report with recommendations for Ministers. The period for written submissions from members of the public has now closed and the authority has provided its response to the appeal. The reporter is looking at the documents and submissions and will consider what, if any, further procedures are necessary in order to consider this appeal. Further updates will follow in due course.
